JUDGMENT 1. Heard the learned counsel appearing for the petitioner, as well as the learned counsel appearing on behalf of the first and the second respondents. 2. At this stage of the hearing of the writ petition, the learned counsel appearing on behalf of the petitioners had submitted that it would suffice if the petitioners are permitted to agitate the matter before the appropriate civil court, for the cancellation of the settlement deed, dated 21.9.2007, and if the civil court considers the issues arising for its consideration, without being influenced by the observations made by the second respondent, in his order, dated 12.9.2012. 3. The learned counsel appearing on behalf of the first and the second respondents has no objection for this court passing such an order. 4. In view of the above, it is made clear that it would be open to the petitioners to agitate the matter relating to the cancellation of the settlement deed, dated 21.9.2007, before the appropriate civil forum, in the manner known to law. It is also made clear that it is for the civil court concerned to examine the issues arising for its consideration, without being influenced by the observations made by the second respondent in his impugned order, dated 12.9.2012. The writ petition is ordered accordingly. No costs. Consequently, connected miscellaneous petition is closed.
