Dilip Gupta, J.— Heard learned counsel for the petitioner and learned counsel for the State-respondents. The petitioner has filed this writ petition as a public interest litigation raising a grievance that a large number of private schools both English medium and Hindi medium which have been impleaded as respondents no. 7 to 47 are operating in Block Mungara Badshahpur, district Jaunpur without having any valid recognition. According to learned counsel for the petitioner, such schools should be proceeded against either for cheating the parents or the students because they falsely represent that they are recognized schools either under the C.B.S.E or some other Boards or they should be subjected to appropriate fine in accordance with the policy decision of the State Government as it is evident from the letter of Secretary to Government of Uttar Pradesh dated 19.5.2011, contained in Annexure-3 to the writ petition. The grievance of the petitioner is that in spite of several letters and representations, the authorities are not taking any action in the matter. It is not clear whether the policy evident from letter dated 19.5.2011, is applicable to all private schools or only Hindi medium schools and whether such policy has been actually made effective or not. But, if the schools are cheating the parents or the students by making false representations in respect of their recognition by C.B.S.E. or some other Boards, the concerned officers of the Education Department, Government of U.P. shall be well advised to take appropriate steps in the matter. Accordingly, we dispose of this writ petition with liberty to the petitioner to file a fresh representation along with a certified copy of this order before the respondent no. 4-Basic Shiksha Adhikari, Jaunpur who shall consider all the relevant facts and take appropriate decision and action in the matter within two months from filing of such representation. Petition is, accordingly, disposed of. _____________
