JUDGMENT 1. - Heard learned counsel for the parties. 2. The present appeal has been filed by the appellant challenging the judgment dated 16.12.2011 passed by the learned Special Judge, N.D.P.S. Act Cases, Hanumangarh in Sessions Case No. 59/2005 convicting him for the offence under Section 8/18(c) of the N.D.P.S. Act and sentencing him to undergo 4 years' rigorous imprisonment & a fine of Rs. 40,000/-, in default of payment of fine, to further undergo 1 year's rigorous imprisonment. 3. At the outset, learned counsel for the appellant submits that he does not challenge the conviction of the appellant but prays that looking to the fact that this is the only case registered against the appellant under Section 8/18 of the N.D.P.S. Act and the fact that the appellant has already remained in custody for a period in excess of 1 year & 11 months, the sentence awarded to the appellant be reduced to the period already undergone. 4. Per contra, learned P.P. opposes the submissions raised on behalf of the appellant. 5. I have given by thoughtful consideration to the arguments advanced at the bar and have perused the impugned judgment as well as the record of the case. 6. From a perusal of the judgment impugned, this Court is of the opinion that the conviction of the appellant cannot be faulted with. The learned subordinate court has rightly arrived at a finding of guilt against the appellant. 7. However, having regard to the fact that the recovery in this case was effected on 14.10.2005 and the appellant has remained in custody for more than 1½ years and since this is the only case registered against the appellant under the N.D.P.S. Act and considering the fact that the recovered opium was found 1 kg. in weight, this Court deems it just and proper to reduce the sentence of the appellant to the period of two years. 8. Resultantly, this appeal is partly allowed and whilst maintaining the conviction of the appellant, the sentence of imprisonment awarded to the appellant is reduced to two (2) years.Appeal partly allowed. *******
