JUDGMENT Mr. Jaswant Singh, J (Oral):- Above mentioned 27 transfer petitions filed by the Haryana Wakf. Board, through its Estate Officer at Panipat seeking the transfer of 27 suits mentioned therein are being disposed of by a common order since the facts are identical in the same. 2. The Wakf. Board/petitioner is seeking the transfer of the aforesaid 27 suits for declaration and permanent injunction from the Court of learned Wekf. Tribunal at Panipat on the ground that the Presiding Officer has a personal grudge against the Wakf. Board as is apparent from his repeated adverse remarks against the functioning of the Board and its Officers, fully detailed in the complaint (P.4). 3. After hearing learned counsel for the petitioner-Wakf. Board, I find that there is no merit in the aforesaid transfer applications. 4. Although, it has been alleged that in view of the contents of para Nos.4 to 6, the personal grudge of the Presiding Officer is writ large, however, it is nowhere shown or prima facie proved that the alleged personal grudge has resulted into miscarriage of justice. It has nowhere been shown that he has passed any order in blatant violation of legal provisions of law or any established facts. Therefore, in my view, these kinds of efforts for Bench hunting to get matters listed before a Court that suits them and armtwist the judicial system are not permissible lest every litigant would be emboldened to resort such process and thus would cause severe and irreparable harm to the proper & disciplined functioning of the judicial system. 5. In view of the above, all the aforesaid transfer applications are dismissed. ---------0.B.S.0------------ —————————
