ATUL KUMAR JAIN

body2013
Hon'ble JAIN, J.—The case was registered as FIR No. 50/2013 of Police Station Kuri Bhagtasani under Section 306 of IPC. The application was dismissed by the Principal Magistrate, Juvenile Justice Board, Sri Ganganagar under Section 12 of the Juvenile Justice (Care and Protection of Children) Act, 2000 (for short `the Act of 2000') on 9.4.2013 and his appeal No. 154/2013 under Section 52 of the Act of 2000 was also dismissed on 16.4.2013 by the learned Sessions Judge, Jodhpur Metropolitan. 2. This Criminal Revision has been filed by the accused-petitioner Aditya Kumar @ Bebby under Section 53 of the Act of 2000. 3. The facts of the case have been narrated by the court below in their orders which need not be repeated again. 4. I have heard both the parties and perused the case diary also. 5. It has been argued on behalf of the petitioner that he is a student and he has taken his Class XIIth Examination recently. It is alleged that the petitioner used to sexually harass deceased Smt. Shalu, whose husband was in jail in some criminal case and because of sexual harassment caused by the petitioner, the lady was compelled to commit suicide by hanging herself from a ceiling fan. The report was lodged by the brother of the lady. The matter is at the stage of investigation. My attention has been drawn to the statements of Jinu S/o Heera Lal, Smt. Pinki d/o Heera Lal and other evidence in the case diary. 6. I think it is a case in which if the juvenile delinquent-petitioner is enlarged on bail, then certainly it will defeat the ends of justice. To check the rising trend of serious crimes which are being committed by juvenile delinquents these days, it is necessary for courts to see that ends of justice should not be allowed to be defeated by untimely release of such juvenile delinquents. 7. Hence, without expressing any opinion on the merits of the case, this revision petition filed by petitioner Aditya Kumar is hereby dismissed at this stage.
