Sibghat Ullah Khan, J.;— Heard learned counsel for the petitioner and learned standing counsel for the respondents. Petitioner's licence/agreement/dealership to run fair price shop situate in village Nagalia Aquil Tehsil Sadar, District Rampur was cancelled by Deputy Collector, Sadar Rampur through order dated 12.3.2007. Against the said order petitioner filed appeal no.77 of 2007-08 which was dismissed by Deputy Commissioner (Food), Moradabad, Division Moradabad on 6.8.2008, hence this writ petition. Show cause notice was issued on 22.1.2007. Several card holders had filed complaint against the petitioner regarding irregularities in distribution of essential commodities. In the order passed by the Deputy Collector specific details have been given mentioning the names of card holders and their card numbers. Scores of B.P.L. and Antayodya card holders complained that for several months commodities were not being supplied to them. This version was proved by there ration cards which did not contain endorsement of distribution of essential commodities for several months. Earlier also several times proceedings were initiated against the petitioner regarding irregularities including non supply of essential commodities meant for child nutrition programme regarding which complaint had been made by B.S.A. (in 1997). The petitioner's licence/shop was suspended and afterwards by issuing warning etc. it was restored. Same thing happened in 1998,1999, 2002, 2004. For three months commodities were not distributed to the several card holders and there was no entry on the said cards, however, in this regard distribution registers were not produced. Through show cause notice copy of which is Annexure 1 to the writ petition petitioner was directed to produce last three months sale registers which he did not do. Non production of distribution register was fatal. On earlier occasions also petitioner had been found to have committed irregularities in distribution. It was utterly wrong on the part of the authorities to take lenient view at earlier occasions. Whenever irregularities are found proved licence shall be cancelled immediately after providing opportunity of hearing. In view of wholesale irregularities being committed by ration shop owners it is very essential that regular inspection shall be made and on any serious irregularity in distribution licence shall be cancelled. In the impugned order it is mentioned that earlier on 2.8.2005 petitioner's licence was cancelled however, the said order was set aside by the High Court in writ petition.

The said order was set aside in writ petition nos.75981 of 2005 by a Division Bench through order dated 15.12.2005. However, from the perusal of the said file it transpired that the said order had been obtained by filing a manipulated copy of the cancellation order. Afterwards it was pointed out in the said writ petition that the copy of the cancellation order was manipulated hence through order dated 4.5.2007 operation of order dated 15.12.2005 was suspended. Thereafter, the said writ petition was dismissed on 21.5.2010. Accordingly, I do not find least error in the impugned order. Writ petition is, therefore, dismissed. Office is directed to supply a copy of this order free of cost to Sri S.P. Misra learned standing counsel for sending the same to the Principal Secretary concerned. _____________
