JUDGMENT Mr. Naresh Kumar Sanghi, J.:- Prayer in this petition is for grant of regular bail to the petitioner, Charanjit Singh @ Goldy, son of Gurbachan Singh, resident of House No. 45, Jaimal Nagar, Jalandhar, who has been booked for having committed the offences punishable under Sections 120-B, 364 and 365, IPC, in a case arising out of FIR No. 217, dated 30.12.2012, registered at Police Station, Maqsudan, District Jalandhar. 2. Learned counsel contends that not an iota of legal evidence has emerged on record to connect the petitioner with the alleged crime. He further submits that the petitioner is behind the bars from 11.3.2013 and after investigation the charge-sheet (report under Section 173, Cr.P.C.) has already been submitted before the learned Area Judicial Magistrate. 3. Learned counsel for the State on instructions from SI Pritam Singh of Police Station, Maqsudan, District Jalandhar, very fairly concedes that except the statements of the father of the prosecutrix and her uncle, no other evidence has emerged against the petitioner connecting him with the offences for which he has been booked. He further submits that in his supplementary statement, the complainant, Surinder Kumar, disclosed to the police that from his sources he came to know that the petitioner along with his co-accused had abducted the prosecutrix. 4. Learned counsel for the complainant submits that during course of investigation the petitioner confessed his guilt, therefore, the said part of the investigation be considered as evidence against the petitioner. 5. Heard. 6. The confession of the accused before the police cannot be considered as legal evidence against the petitioner. Except the statements of the father and uncle of the prosecutrix, there is no other material to connect the petitioner with the alleged crime. He is behind the bars from 11.3.2013 and after investigation the charge-sheet (report under Section 173, Cr.P.C., has already been presented before the learned Area Judicial Magistrate. 7. Keeping in view the totality of the facts and circumstances of the case and the fact that investigation qua the petitioner is complete, the present petition is allowed. The petitioner, Charanjit Singh @ Goldy, son of Gurbachan Singh, resident of House No. 45, Jaimal Nagar, Jalandhar, is ordered to be released on bail during pendency of the trial of this case, subject to his furnishing bail bonds to the satisfaction of the learned Chief Judicial Magistrate/Duty Magistrate, Jalandhar. --------0.B.S.0------------ ———————————
