Judgment : 1. Petitioner apprehends arrest by the Medial College Police, Thiruvananthapuram in a non bailable offence. 2. Learned Public Prosecutor has submitted that a complaint was received from one Gokuladasan Pillai that he transferred Rs.62,000/-to the account of the petitioner who is working in a travel agency for a tour package beginning from 28.09.2013 but he was cheated. 3. Learned counsel submits that the petitioner is only an employee of the travel agency. 4. Petitioner is being harassed by the police with direction to pay the amount. It is submitted that the de facto complainant is not proceeding against the Managing Director of the travel agency who received the money for arranging the tour package. 5. According to the learned Public Prosecutor, no case is registered against the petitioner. 6. Having regard to the above, I am inclined to issue the following directions. (i) Petitioner shall appear before the Officer enquiring into the complaint as and when required for the purpose, in writing, at all reasonable time and place. (ii) In case the petitioner is arrested for any non bailable offence based on the complaint preferred by Gokuladasan Pillai, she shall be released on bail on her executing bond for Rs.15,000/- (Rupees Fifteen Thousand Only) with two sureties to the like sum each before the Arresting Officer and subject to the following conditions: a) Petitioner shall report to the Investigating Officer as and when required for interrogation at all reasonable time and place. (b) Petitioner shall co-operate with the investigation of the case. The application is disposed of as above.
