JUDGMENT Heard Mr. D. Mazumdar, learned counsel for the petitioner and Mr. S. Chamaria, leaned counsel for the respondent. Both the learned counsel for the parties submit that the matter has already been settled between the parties and, therefore, cause of action to prosecute the writ petition does not survive any more. We accept this submission and, accordingly, dismiss the writ petition as having rendered infructuous in the light of the settlement arrived at between the petitioner and the respondent in relation to the subject matter of writ petition. No cost.
