JUDGMENT 1.This is an application for bail under section 438 of Cr.P.C. for offence under Sections 376(2), 420, 313, 506 of IPC in connection with Crime No. 84 of 2014 registered at police station Rupjhar, District Balaghat. 2. According to prosecution on 05/12/2007 petitioner committed rape on prosecutrix aged about 25-30 years. 3. Learned counsel for petitioner submits that FIR lodged in this case after more than 7 years i.e. 17/07/2014. In fact it was case of consent report has been lodged because of some difference and gap in aforesaid relationship. 4. Learned counsel for State submits that petitioner misused his capacity of doctor and forced prosecutrix for abortion also. 5. Learned counsel for petitioner submits that there had been relationship between them for about 7 years. 6. Without commenting on merits of the case, on due consideration of the facts and circumstances of the case, I deem it proper to grant bail to the petitioner. Petitioner Dr. Arun Bisen is directed to join the investigation immediately and fully cooperate with the investigating agency and the trial. In the event of arrest, petitioner shall be released on bail on his furnishing a personal bond in a sum of Rs. 30,000/- with a separate surety of like amount to the satisfaction of arresting officer. Conditions of Section 438(2) Cr.P.C. shall apply on the petitioner during currency of bail. C.C. as per rules.
