JUDGMENT Mr. T.P.S. Mann, J.: (Oral) - Prayer made in the petition is for the grant of regular bail to the petitioner during the pendency of the trial of the case arising out of FIR No. 53 dated 24.7.2013 registered at Police Station Dhilwan, District Kapurthala under Sections 377 and 511 IPC and Section 4 of the Protection of Children from Sexual Offences Act. 2. As per the prosecution, the petitioner after removing the shorts worn by 11/12 years’ old grand-son of the complainant was trying to commit carnal intercourse with him at the time of the occurrence. 3. The petitioner is in custody since 6.8.2013. He had earlier filed CRM M-40427 of 2013 for the grant of regular bail but the said petition was dismissed as withdrawn on 5.12.2013. The investigation of the case is complete and the police has presented the challan. Subsequent to the framing of charges, the prosecution has examined six of the sixteen witnesses cited by it and the next date fixed before the trial Court is 16.9.2014. 4. The pace at which the trial is proceeding, it is likely to take a long time for its conclusion. 5. The petition is allowed.
