JUDGMENT Mr. M.M.S. Bedi, J.: (Oral) - Petitioner seeks the concession of pre-arrest bail in a case registered at the instance of Amarjit Singh alleging that his sister Akwinder Kaur committed suicide on account of maltreatment of her husband Darshan Singh and other family members. 2. So far as petitioner is concerned, she is not the family member of Darshan Singh but she is related to him being maternal aunt. There are allegations against the petitioner that on account of her objectionable extramarital relation with the husband of the deceased suicide was committed by deceased Akwinder Kaur. The petitioner is stated to be mother of two children. The evidence gathered by the investigating agency pertaining to the culpability of the petitioner appears to be on weak footing. There does not appear to be sufficient material till date regarding the nature of the relationship of the petitioner with the deceased. It will certainly be a debatable issue in context to the requirement of Section 107 IPC whether the petitioner is guilty of having abetted the suicide by any direct or indirect action. Petitioner has joined investigation and is stated to be not required for custodial interrogation. 3. Petition is allowed and it is ordered that in case of arrest of the petitioner she will be released on bail to the satisfaction of the arresting officer subject to the conditions that she will join investigation as and when required by the police and that she will not tamper with the evidence or hamper the investigation in any manner. ---------0.B.S.0------------ —————————
