body2014
Judgment : K.K. Sasidharan, J. 1. This writ petition at the instance of a candidate contesting for the Madurai Lok Sabha Constituency seeks a writ of declaration, declaring that the election held on 24 April 2014 for the Madurai Lok Sabha Constituency is invalid and to direct the respondents to conduct re-election in a fair and transparent manner. 2. According to the petitioner, there was a meeting at Nadana Gapala Nayaki Mandir near Theppakulam on 7 April 2014. The meeting was attended by a State Minister and the Law Officers appointed by the Government of Tamil Nadu. The petitioner submitted a complaint before the Police alleging that the Minister and the Government Pleaders are taking part in the election campaign. According to the petitioner, the ruling party distributed money to the voters and therefore fair election was not conducted. The petitioner therefore wanted to declare the election conducted on 24 April 2014 as null and void and to hold re-election for the Madurai Lok Sabha Constituency. 3. The affidavit filed in support of the writ petition is bereft of details. The petitioner has given certain reasons, which according to him vitiated the assembly election. The reasons given in the affidavit filed in support of the writ petition are not sufficient to declare the election conducted by the Election Commission of India as null and void. 4. There is absolutely no merit in this writ petition stated to be filed in public interest. We, therefore do not find any reason to entertain this writ petition. 5. In the result, the writ petition is dismissed. Consequently the connected MP is closed. No costs.
