Tejinder Singh Dhindsa, J. 1. This order shall dispose of the present petition filed under Section 439 Cr.P.C. praying for the grant of regular bail to the petitioner in case F.I.R. No. 122 dated 7.8.2013 under sections 21, 22, 61, 85 of N.D.P.S. Act, registered at Police Station, Chamkaur Sahib, District Rupnagar. Learned counsel for the parties have been heard. 2. As per prosecution version an alleged recovery of 1200 M.L. intoxicating liquid was effected from the petitioner and which as per report of F.S.L. contains Codeine Phosphate. 3. It has gone uncontroverted that 1200 M.L. would be equivalent to 1092 gms. As per Schedule to the N.D.P.S. Act 1000 gms. and above of such intoxicating liquid would be construed as commercial quantity. 4. The alleged recovery from the present petitioner is marginally over and above the commercial quantity. The petitioner has been in custody since 7.8.2013. 5. Learned State counsel upon instructions from H.C. Kulbir Singh would submit that the petitioner is not involved in any other proceedings under the N.D.P.S. Act and the final report having been submitted, the trial is still at the initial stage inasmuch as out of 8 prosecution witnesses cited none has been examined till date. The trial, as such, shall take some time to conclude. Without making any observations on the merits of the case, this Court is of the considered view that the petitioner is entitled to the benefit of regular bail. Present petition is, accordingly, allowed. Bail to the satisfaction of the Trial Court. Petition disposed of.
