body2014
Judgment : 1. The writ petition has been filed seeking for the issuance of a Writ of Mandamus, directing the 1st Respondent to issue the Hall Ticket to the petitioner and to permit him to appear for M.Ed. Examination (Regular Course) and also to participate in Viva subsequently. 2. Heard the learned counsel appearing for the petitioner. 3. The learned counsel for the writ petitioner would submit that the petitioner is qualified to attend the examination, including the attendance. But in the list of eligible candidates, the petitioner's name is missing and the second respondent may prevent the petitioner from appearing the Examination. Therefore, he prayed for issuing a direction to the first respondent to issue Hall Ticket to the petitioner and permit him to appear for M.Ed. Examination (Regular Course). 4. A perusal of the letter dated 22.05.2014, issued by the second respondent college reveals that only on the ground of petitioner's name missing in the list of eligible candidates, the petitioner was directed to contact the University and then obtain the Hall Ticket. Further, the learned counsel appearing for the writ petitioner submitted that the writ petitioner is fully qualified to attend the examination. But due to the mistake committed by the University to include the name of the petitioner in the list of eligible candidates, the second respondent refused to permit the petitioner to write the examination on 30.05.2014. Therefore, he prays for an order, permitting the writ petitioner to write the examination. 5. Considering the above said submissions and the date of examination i.e. on 30.05.2014, this Court is constrained to pass the following order: The first respondent University is directed to issue Hall Ticket to the writ petitioner, if, he is fully qualified to attend the examination, immediately ie., on or before 29.05.2014 and to permit the writ petitioner to appear for M.Ed. examination (Regular Course) as prayed for in the writ petition. 6. With the above observations, this Writ Petition is closed. No costs. Consequently, connected M.P.(MD) No.1 of 2014 is closed.
