JUDGMENT : M.M.S. Bedi, J. 1. The petitioner seeks concession of regular bail in a case registered on the basis of recovery of 90 grams narcotic powder. Petitioner was arrested on 30.08.2013 and 180 days expired on 01.03.2014. However, incomplete challan was presented on 19.12.2013 without report of Chemical Examiner. Chemical report indicating that powder contained diphenoxylate hyrdochloride, was received on 24.03.2014. 2. Petitioner moved an application for bail under Section 167(2) Cr. P.C. on 03.03.2014 which was dismissed on 09.04.2014. 3. The prosecution agency in the present case had not filed any application for extension of time under Section 36 A(4) of N.D.P.S. Act. 4. It is a fact that when challan was presented before 180 days, by that time it had not been detected whether the powder recovered from the petitioner contained diphenoxylate hyrdochloride. The petitioner had acquired indefeasible right on expiry of period of 180 days. 5. In view of the above said circumstances, the petitioner could have been granted concession of bail under Section 167(2) Cr. P.C. Petition is allowed. Petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the trial Court.
