JUDGMENT Hon'ble Dilip Gupta,J. An order has been passed against the petitioner on 16 January 2014, by which an amount of Rs.2,16,020/- is to be recovered on a finding that the petitioner has made an illegal excavation of earth from Plot No. 731, area 4.715 hectare, situated at village Papad Hamjapur, Tehsil Dataganj, District Bulandshahr. The petitioner has filed an appeal together with a stay application before the Commissioner, Bareilly Division, Bareilly on 17 February 2014 under Rule 77 of the Uttar Pradesh Minor Minerals (Concession) Rules, 1963. 2. All that we intend to direct in the present case is that the appellate authority may either dispose of the appeal itself expeditiously or, if that is not possible, to take up the stay application within a period of one month from the date of production of a certified copy of this order. 3. In this view of the matter, no separate orders are required to be passed on the application for impleadment moved by the original complainant. 4. The writ petition and the impleadment application are, accordingly, disposed of. There shall be no order as to costs.
