JUDGMENT P.S. Rana Judge (Oral) Learned Advocate appearing on behalf of the parties submitted before the Court that compromise has been executed inter-se the parties and present suit be disposed of under Order 23 Rule 3 CPC. Separate statements of learned Advocates recorded and placed on record. In view of the statements of the learned Advocates placed on record it is ordered that defendants would pay an amount of Rs.23 lacs (Rupees twenty three lacs) to the plaintiff in three equal installments on or before 15.9.2014. It is further ordered that in case defendants did not pay the amount of Rs.23 lacs in three equal installments on or before 15.9.2014 to the plaintiff then defendants will be liable to pay an amount i.e. Rs.46 lacs (Rupees forty six lacs) to the plaintiff. At this stage learned Advocate appearing on behalf of the defendants handed over three ordinary cheques dated 8.9.2014, 10.9.2014 and 12.9.2014 to the learned Advocate appearing on behalf of the plaintiff. Photocopies of these cheques are retained in the file. Present suit is disposed of accordingly. Compromise decree sheet be drawn accordingly. Parties are left to bear their own costs. Court fee be refunded strictly in accordance with law. Report of learned Mediator dated 4.7.2014 will form part and parcel of the decree sheet.
