JUDGMENT 1.Heard. 2. This petition under Article 226 of the Constitution of India by the petitioners has been filed against the advertisement issued by the respondent No. 3 Municipal Courncil, Porsa District Morena for filling up the post of Safai Saranshak by direct recruitment. 3. Counsel for the petitioners submits that true it is that for the similar relief another writ petition being W.P. No. 3824/2009(S) filed by some of the petitioners is pending consideration wherein notices have been issued vide order dated 24/08/2009 passed by a coordinate Bench of this Court. However, after issuance of notice by this Court at that time, the respondents withdrew the advertisement so issued to fill up the aforesaid posts by way of direct recruitment. 4. Now, with the passage of time, the cause of action arose because the respondents have issued an advertisement for filling up the aforesaid post by direction recruitment. Hence, the similar relief is claimed in this writ petition. 5. The fact remains that for similar nature of relief, another W.P. No. 3824/2009(S) is pending. Therefore, on a query being made by this Court in that behalf, counsel for petitioners prays that he may be given liberty to withdraw this petition and file an appropriate application in the pending writ petition for redressal of grievance raised by the petitioners in this writ petition. Liberty as prayed for is granted. Accordingly, this petition stands disposed of as withdrawn with the liberty prayed for. Certified copy as per rules.
