JUDGMENT This Criminal Misc. Petition has been filed u/s 482 Cr.P.C against the order dated 31.8.2012 passed by Addl.Chief Judl. Magistrate no.11, Jaipur Metroplotan, Jaipur whereby amendment in the relief clause has been allowed to respondent. During the course of argument, counsel for petitioner does not press about amendment as objection has already been filed and the same has been allowed by the court below but his only contention is that amendment should not be related back to the date of presentation which is 25.11.2009 because in that situation amendment in the relief clause which is related to amount of maintenance will definitely prejudice his case. Counsel for the respondent has stated that as per provisions of law, amendment should be related back from the date of petition. Both the counsel of the parties has apprised this court about the fact that now the case is fixed for final argument before the court below, hence the contention and objection of present petitioner could be raised before the court below. It is needless to say that the court below should also consider this aspect of the matter before deciding the petition finally. With this direction this petition is disposed of.
