Order I have been informed that large numbers of children have been rescued from Chakwasa Ashram within the district of Vaishali and they are residing in the Alpawas Grih, Vaishali, Hajipur. Since most of them are too young, as I am told, to give their address, it is desirable that the following steps be taken immediately by the Training-cum-Rehabilitation Officer, Alpawas Grih, Vaishali, Hajipur: (i) All the children be individually photographed so that their features are prominently displayed; (ii) If, at all, they are able to disclose their names, the photographs would contain the names of the children and such particulars as they are able to furnish. (iii) A list along with photographs of all the children shall be forwarded to the Social Welfare Board for publication in the Newspapers both in English as well as in Vernacular having wide circulation in Bihar/other States, if there are children of other States also. (iv) The photographs shall also be displayed in National and local TV which has special programme for such information. (v) A list of photographs and details, if any, shall also be simultaneously forwarded to the Secretary General of Hon’ble Supreme Court where the cases of missing children from all over country is being monitored vide Bachpan Bachao Andolan Vs. Union of India so that the present list may be tagged with the case concerned. The entire exercise shall be completed within a period of three weeks from the date of receipt of the communication. I am also informed that a number of girls, who have attained majority in cases of alleged kidnapping are being kept in the Rehabilitation Centre/Help Line even sometimes against their will. Thus, evidently, it is a violation of their fundamental rights as guaranteed under Article 21 of the Constitution of India. In such circumstances, whenever a Medical Board on assessment declares an inmate as major, the Officer of Rehabilitation Centre/Help Line, shall forward her to the Court concerned with the relevant documents, within 15 days. Thereafter, the Court after recording her stand on kidnapping shall release her on such bonds as it may found fit and proper. The assessment of age shall be periodically checked by the Officer of Rehabilitation Centre/Help Line, and if it is found that on the date of review the girl concerned has attained/about to attain majority, the records be sent to the Court concerned for acting as mentioned above.

It is again clarified that after an inmate is medically examined, the Medical Report shall be compulsorily forwarded to the Court concerned for needful action on the same. It is learnt that there are some mentally challenged inmates in the Rehabilitation Centre. Some of them have regained their mental health and are in a position to give information about their addresses which have been verified by the Rehabilitation Centre authorities. In some cases, after due publication of notices, Claimants have appeared for their custody. In the aforesaid situation, the Protection Officer, Women’s Help Line, Vaishali/Training-cum-Rehabilitation Officer, Alpawas Grih, Vaishali, Hajipur, are directed to release the inmates after due verification of all the documents of the Claimants and inform the Court/Authorities concerned with regard to the action taken. Put up on 12.01.2015 under the heading “To Be Mentioned” when an Affidavit shall be filed by the Protection Officer, Women’s Help Line, Vaishali/Training-cum-Rehabilitation Officer, Alpawas Grih, Vaishali, Hajipur, that the aforesaid task has been completed. Let this order be communicated to the District Magistrate, Vaishali, through FAX at the cost of the State for its onward communication to the Officers concerned.
