JUDGMENT HON'BLE DILIP GUPTA, J. The petitioner has sought a mandamus directing the State to remove the unauthorised occupation of respondent nos.5 to 8 from Plot No.477 which is registered as a public way in Village-Nuruddinpur, Pargana-Anguli, Tehsil-Shahganj, District Jaunpur. 2. From the records, it appears that an order was passed under section 122-B of the U.P. Zamindari Abolition and Land Reforms Act, 1950 by the Assistant Collector/Tehsildar (Judicial) on 13 June 2012. From the records, it does not emerge as to whether any further proceeding has been adopted by respondent nos.5 to 8 for challenging the order or whether the order under section 122-B has been set aside, modified or varied in appeal. 3. Accordingly, particularly since the private respondent are not before the Court, we direct that the Sub-Divisional Magistrate, Shahganj, District Jaunpur, namely the third respondent to verify with due notice to the private respondents, as to whether the order under section 122-B has been varied, modified or set aside by the higher Court. If the order continues to subsist and it has not been stayed, modified or varied, necessary steps shall be taken in accordance with law to enforce the order expeditiously. 4. The writ petition is, accordingly, disposed of.
