D.Y.CHANDRACHUD, DILIP GUPTA

body2014
JUDGMENT HON'BLE DILIP GUPTA,J. The petition has been filed ostensibly in the public interest but there is no disclosure as required by sub-Rule 3-A of Rule 1 of Chapter XXII of the Allahabad High Court Rules, which was amended following the judgment of the Supreme Court in State of Uttaranchal Vs. Balwant Singh Chaufal & Ors., reported in 2010 AIR SCW 1029. 2. From the records it emerges that an Enquiry Committee was constituted by the District Inspector of Schools on 1 August 2013 and a report has been submitted on 16 September 2013. Since the District Inspector of Schools is seized of the matter, there is no reason for this Court to presuppose that as a public authority, he would not act in accordance with law. 3. For these reasons, we find that no ground is made out to entertain the petition or for any other direction by the Court. 4. The petition is, accordingly, dismissed.
