JUDGMENT 1.He is heard. 2. This criminal revision has been filed by the petitioner against the order dated 26/8/2014 passed by the Court below whereby the Court has rejected the private complaint filed by the petitioner for the offences punishable under sections 7, 12, 13 and 15 of the Prevention of Corruption Act, under sections 109, 119, 120B, 121B, 167, 17, 409, 420, 467, 468, 471 and 477A IPC and sections 17 and 41 of Representation of People Act, 1950 on the ground that no prior permission was taken by the petitioner from the appropriate Government. Aforesaid aspect has been considered by Hon'ble the Supreme Court in the case of Anil Kumar Vs. MK Aiyappa, 2013 (1) SCC 705. 3. It is contended by learned counsel for the petitioner that at the time when the offence was committed, the respondents were in public service, however, subsequently, they were retired, hence, no permission is necessary. In support of his contention, learned counsel placed reliance on State of Orissa Vs. Ganesh Chandra Jew, (2004) 8 SCC 40 . 4. In view of subsequent judgment of Hon'ble the Supreme Court in Anil Kumar's case (supra), in our opinion, prior permission from the appropriate Government is necessary because commission of the offence is relating to the period when the respondents were in service. 5. No case is made out for entertaining this revision petition. It is hereby dismissed.
