JUDGMENT 1. - Petitioner Sarvjeet Singh a Juvenile in conflict with law has preferred this revision under Section 53 of the Juvenile Justice (Care and Protection of Children) Act, 2000 (hereinafter referred as 'the Act of 2000) for seeking his release on bail in connection with F.I.R. No. 158/2014; under Sections 323, 341 and 143 of Indian Penal Code Police Station Raisingh Nagar, District Sriganganagar, since he had failed to secure the bail from Juvenile Justice Board vide its order dated 27.5.2014 and learned Lower Appellate Court/ Sessions Judge, Sriganganagar in Criminal Appeal No. 91/2014 decided 29.5.2014. Hence this revision. 2. The brief facts of the case are that complainant Harbahs Singh gave his Purcha Bayan at Government Civil Hospital, Sriganganagar, in respect to the incident occurred on 4.5.2014, on the basis of which an F.I.R No. 158/2014 was registered against the present petitioner and other accused persons for the offences under Sections 323, 341, 143 I.P.C. and investigation commenced. 3. On being arrested, the revisionist moved a bail application for his release before learned Juvenile Justice Board under Section 12 of the Act of 2000 but remained unsuccessful and his such an endeavour was rejected by the learned Juvenile Justice Board vide its order dated 27.5.2014 and subsequently challenged the Board's order before learned lower Appellate Court/Sessions Judge, which also met with negative fate as his appeal too was dismissed vide judgment dated 29.5.2014 Hence, this revision. 4. I have heard Mr. Trilok Joshi, learned Counsel for the revisionist in support of this revision petition and Mr. V.S. Rajpurohit, learned Public Prosecutor for the State of Rajasthan. 5. Learned Counsel for the petitioner has submitted that main accused against whom the allegation of causing grievous injury was alleged has already been released on bail by order of the learned Additional Sessions Judge, Raisinghnagar, District Sriganganagar vide order dated 30.5.2014. His bail application under Section 12 and appeal thereof has been wrongly dismissed by both Court below. The present petitioner is juvenile and is in custody since 27.5.2014 and he is only 15 years old boy. No criminal antecedents are there against the present petitioner, therefore, he may be released on bail. 6. Learned Public Prosecutor supported the impugned orders. 7. I have considered the submission made by learned Counsel and the learned Public Prosecutor.
The present petitioner is juvenile and is in custody since 27.5.2014 and he is only 15 years old boy. No criminal antecedents are there against the present petitioner, therefore, he may be released on bail. 6. Learned Public Prosecutor supported the impugned orders. 7. I have considered the submission made by learned Counsel and the learned Public Prosecutor. Since main accused Mahendra Singh has already been released on bail and petitioner is juvenile and is in custody since 27.5 2014, therefore, without going into the gravity of the offence, this revision petition deserves to be allowed which is hereby allowed and impugned orders passed by the Juvenile Justice Board as well as lower Appellate Court are set aside and it is directed that revisionist be released on bail if his natural guardian (Tayaji), Shri Jogendra Singh S/o Shri Fauja Singh furnishes a personal bond of ? 50,000/- with two solvent sureties of T 25,000/- each to the satisfaction of the Juvenile Justice Board, Sriganganagar in F.I.R. No. 158/2014, P.S. Raisinghnagar, Sriganganagar under Sections 323, 341 and 143 I.P.C. on the condition that revisionist shall be admitted in an educational institute/school and his natural guardian shall take care of his education and betterment, that he will not allow him to indulge in any criminal activity and will keep a check on other activities also. He is further directed to keep present the juvenile on each and every date of hearing and whenever called upon to do so before the learned Juvenile justice Board Sriganganagar or where the case is being transferred.Copy of the order be sent to the learned Juvenile Justice Board, Sriganganagar. *******
