Judgment Sanjay Karol, J. Petitioner who is working as Staff Nurse on contract basis in the Health Department, in terms of impugned order of transfer dated 17.2.2014 (Annexure P-1), stands transferred from Community Health Centre Amb to Community Health Centre, Shansha, District Lahaul Spiti. 2. It is seen that petitioner has made a representation dated 24.2.2014 (Annexure P-3) to the 2nd respondent, bringing out her grievances with regard to the impugned order of transfer (Annexure P-1), which is still pending before the authority concerned. 3. Under instructions, learned counsel for the petitioner, submits that petitioner shall be content, if a direction is issued to the said respondent to decide representation (Annexure P-3) expeditiously. Learned Advocate General, has no objection to the above request. 4. Leaving the questions of law open, a direction is issued to the 2nd respondent/competent authority to consider and decide the petitioner’s representation (Annexure P-3), in accordance with law, by affording due opportunity of hearing/representation to the petitioners, within a period of two weeks from the date of production of certified copy of this order. Needless to add, the authority shall assign reasons while deciding the same, which shall be communicated to the petitioner. 4. Learned counsel for the petitioner submits that petitioner has yet not been relieved. If that be so, we stay the operation of impugned order of transfer dated 17.2.2014 (Annexure P-1). With the aforesaid observations, petition stands disposed of, as also, pending application(s), if any.
