ORDER This Criminal Misc. Bail Application u/s 439 Cr.P.C has been filed for grant of bail in FIR No.525/2013 registered with ACB Chowki Bundi for the offences u/ss 7, 13(1) (d) and 13(2) of Prevention of Corruption Act. Heard learned counsel for the petitioner and learned Public Prosecutor and perused the relevant material placed before me. The contention of learned counsel for the petitioner is that no work is pending with the present petitioner of the complainant and even he was not authorized to record the complainant's name in the revenue record and for that the decree of competent court is needed. Present petitioner is behind the bar since 5.12.2013. He is 58 years of age and is ill. He has been falsely implicated in the matter hence he be released on bail. Per contra contention of learned Public Prosecutor is that present petitioner has demanded the money which has been verified and transcript is also there to this effect. Money has also been recovered from the possession of the present petitioner hence he be not released on bail. After considering the facts and circumstances of the case, it is not a fit case to release the petitioner on bail. Bail Application stands dismissed.
