Karam Chand Puri, J. 1. Vide this order, I intend to dispose of CRM-M-30280 of 2014 titled as Randhir Singh v. State of Punjab and CRM-M-30282 of 2014 titled as Baldev Raj Verma v. State of Punjab, as both these petitions have arisen out of the same FIR. Both the petitioners have applied for grant of anticipatory bail in F.I.R. No. 48 dated 13.6.2013 under Sections 409, 120-B I.P.C., registered at Police Station Banga, District Nawanshahr (S.B.S. Nagar). 2. As per allegation of the prosecution, one Yash Pal Singh, Inspector, Food Civil Supplies at Banga, has made embezzlement of huge quantity of wheat stock from the year 2009 onwards. 3. So far as the applicants are concerned, their name does not appear in the FIR. However, during the investigation, the allegation against them is that they have made physical verification, which physical verification was wrong. Baldev Raj Verma - applicant has conducted physical verification in the month of June 2010 and no shortage was found. Whereas Randhir Singh - applicant conducted the physical verification for the years 2010-11, 2011-12 and in October 2012. But later on in the month of August, 2013 shortage of 35118 bags was found in respect of wheat crop procured in the year 2009-10 and 171595 bags were found less for the year 2010-13. Report of the Deputy Director (Field), Food Civil Supplies, Rupnagar, has been placed on the file and from the perusal of the said report, the ultimate analysis drawn is that 35118 bags relating to the year 2009-10 and 171595 bags relating to the year 2010-13 were found short. 4. So far as, Baldev Raj Verma - applicant is concerned, he has conducted two physical verifications i.e. on 1.1.2010 and 8.6.2010. Admittedly, Baldev Raj Verma was not posted at Banga and was posted at Balachaur. He was not in physical possession of the bags. 5. So far as verification conducted by Randhir Singh - applicant is concerned, there is no shortage in respect of years 2010-11 and 2011-12. Even in the report submitted by Deputy Director (Field), the shortage is in respect of wheat crop relating to year 2012-13. Randhir Singh was also posted outside Banga. So, considering whole of the circumstances, in my view, it is a fit case to allow the concession of anticipatory bail to both the petitioners. So, in these circumstances, the application for grant of anticipatory bail to both the petitioners, stands accepted and the petitioners are ordered to be released on bail on their furnishing bail bonds to the satisfaction of SHO/Investigating Officer on the following conditions as envisaged in Section 438(2)Cr.P.C.:- i) that the petitioners shall make themselves available for interrogation, as and when required, by the police; ii) that the petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer; and iii) that the petitioners shall not leave India without the prior permission of the Court and shall surrender their passport, if any.
