JUDGMENT 1.Heard on the bail application. Case has been perused. 2. This is the first bail application filed by applicant under Section 438 of the Cr.P.C. for grant of anticipatory bail. Applicant is apprehending his arrest in connection with Crime No. 258/2014 registered at Police Station Kotwali District Datia for the offence punishable under Sections 304-B, 302, 498 of IPC. 3. At the outset learned counsel for the applicant prayed for withdrawal of this application with liberty to move a regular bail application before the trial Court. 4. In view of the aforesaid, present anticipatory application is dismissed as withdrawn reserving liberty to the applicant that if he surrenders before the trial Court on or before 27-10-2014 and moves an application for regular bail then the same be considered after giving information to Investigating Officer and on perusal of case diary or challan papers as the case may be, as soon as possible, preferably on the same day in accordance with law. With the aforesaid this application is disposed of.
