JUDGMENT Hon'ble Pankaj Mithal, J. Heard learned counsel for the petitioner. 2. Petitioner has filed this petition for a direction to decide case no. 647 of 2011 (Sunil Kumar Vs. Mamta) under Section 13 of the Hindu Marriage Act, 1955 which is pending in the court of Principal Judge, Family Court, Varanasi expeditiously within a time bound period. 3. In view of the decision of the Division Bench in the case of Km. Shobha Bose Vs. Judge Small Causes Court 2010 (1) ADJ 531 (DB) it is not possible to issue any positive direction for the time bound disposal of the case without ascertaining the pendency of other cases in the court concerned and in the absence of any allegation that the court below is deliberately delaying its disposal. 4. However, as the above case is under Section 13 of the Hindu Marriage Act, 1955 and the said Act vide Section 21 B (2) read with Rule 57 of the Rules framed thereunder provides for a time bound disposal of the proceedings under the Act, the petition is disposed of with liberty to the petitioner to make appropriate application in this regard before the court concerned whereupon the court will consider the matter and do all that is necessary for its expeditious disposal. 5. The petition is disposed of accordingly.
