ORAL ORDER 1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 223/2014 registered at Police Station Excise Circle Ghumka, District-Rajnandgaon for offence punishable under Sections 34 (2) of the C.G. Excise Act, 1915. 2. The prosecution alleges that the applicant was found to be in possession of illicit liquor measuring about 18 bulk liter and he was arrested on 08.02.2014. 3. Learned State counsel has pointed out that the concerned SHO has sent information that the applicant has no previous antecedents of similar offence. 4. Taking into consideration the totality of the circumstances and the fact that the quantity of seized liquor is 18 bulk liters; offence is triable by the Judicial Magistrate First Class and the applicant is in jail since 08.02.2014, this Court is inclined to release the applicant on bail. Accordingly, the application is allowed. 5. It is directed that the applicant shall be released on his executing a personal bond in sum of Rs. 25,000/- with one surety in the like sum to the satisfaction of concerned trial Court. The applicant is directed to appear before the trial Court on each and every date given by the said Court. 6. It is made clear that if the applicant is found to be involved in similar offence again, this order granting bail to the applicant shall automatically stand canceled without reference to the Court and the concerned police shall be at liberty to re-arrest the applicant in this case also, after informing the concerned Judicial Magistrate where trial is pending. 7. At the time of accepting bail bond, the Court concerned shall minutely verify that whether any bail application of the applicant has been decided previously by the High Court or by the Supreme Court and in case the Court finds that previous bail application has been decided, the order shall automatically stand cancelled. 8.
