JUDGMENT : They are heard. Perused the Case Diary. 2. This is first application under Section 438 of Cr.PC filed on behalf of applicant for grant of anticipatory bail. The applicant has been apprehending her arrest in connection with Crime No. 156/2014, registered at police station Mehgaon, District Bhind, for the offences punishable under Sections 302, 304-B, 498-A of IPC and Section 3/4 of Dowry Prohibition Act. 3. On perusal of the Case Diary, it seems that the deceased Sarita has committed suicide on 6th May, 2014 by hanging herself. Her marriage was solemnized with son of the present applicant Smt. Indra five years prior to the incident. Statement of Ramavatar Sharma, who is father of the deceased, has been recorded on 07th May, 2014. The allegations were made by him that his daughter Sarita was subjected to cruelty and harassment and used to beat by her husband. Some omnibus allegations were also made against other in- laws of the deceased. It is also alleged that an amount of Rs.4 lacs was demanded continuously by the husband of deceased in regard to demand of dowry and non-fulfillment of that, she was beaten. 4. Prayer for grant of anticipatory bail is made by the applicant on the ground that the applicant is mother in law and she is residing separately along with her husband. 5. Prayer is opposed by learned Public Prosecutor. Looking to the aforesaid facts and circumstances of the case but without expressing any opinion on the merits of the case and also considering the parivar patra of 2006 and the fact that the applicant is mother in law living separately, the application is allowed. It is directed that the applicant shall surrender before the Investigating Officer on or before 30th October, 2014 and on her furnishing a personal bond in the sum of Rs. 50,000/- (Rupees fifty thousand only) with one solvent surety in the like amount to the satisfaction of the Investigating Officer, she shall be released on bail. The applicant shall also abide by all the conditions enumerated under Section 438(2) of CrPC. M. Cr. C. stands disposed of accordingly. Certified copy as per rules.
