JUDGMENT : Heard. 2. This is first application for bail under Section 439 of Cr.P.C. Applicant has been arrested on 08.09.2014 in connection with Crime No.548/2014 at Police Station Hazira, district Gwalior, M.P. for the offence punishable under Sections 34(2) of M.P. Excise Act. For allegedly in possession of 63 liters of country made liquor. 3. On behalf of the applicant it is submitted that applicant has been falsely implicated. No criminal antecedent is against the applicant. Therefore, applicant be released on bail. 4. Learned Panel Lawyer opposed the application and prayed for its rejection. The trial will not be concluded in the near future. Applicant is in custody since 04.09.2014. Keeping in view the fact, the application is allowed and it is directed that the applicant shall be released on bail on her furnishing a personal bond in a sum of Rs.40,000/- (Rs. Forty Thousand only) with one surety in the like amount to the satisfaction of the Trial Court for securing his presence before the said Court on all the dates of hearing fixed in this regard during trial. 5. This order will remain operative subject to compliance of the following conditions by the applicant:- 1. Applicant will not influence the prosecution witnesses. 2. Applicant will help the progress of the Trial. 3. Applicant will not indulge in any similar offence during the course of Trial. 4. If at all the applicant is found to breach any of the above conditions, the learned Trial Court would be at liberty to reconsider on the question of bail. Certified copy as per rules.
