JUDGMENT Mr. Inderjit Singh, J.:- Baldev Singh etc.-petitioners have filed this petition against the State of Punjab-respondent under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.118 dated 12.8.2013 registered for the offences under Sections 498-A, 406, 323, 506 and 149 IPC at Police Station City Malerkotla, District Sangrur. 2. Notice of motion was issued to the State of Punjab as well as to the complainant. Learned Deputy Advocate General, Punjab appeared on behalf of the respondent-State and the complainant appeared in person and contested the bail petition. 3. From the perusal of the record, I find that Baldev Singhpetitioner No.1 is father-in-law, Daljit Kaur-petitioner No.2 is mother-inlaw, Ravinder Singh-petitioner No.3 is brother-in-law and petitioner No.4- Manjit Kaur is sister-in-law of complainant-Mohinderjit Kaur. The interim bail has been granted to the present petitioners vide order dated 2.9.2013 passed by this Court and they have joined the investigation. 4. At the time of arguments, it has been argued that all the dowry articles have been recovered except the gold ornaments of about 11 Tolas. Learned counsel for the petitioners states that the petitioners are not in possession of any gold ornaments. The husband of the complainant has already been arrested and is on regular bail. 5. I have perused the Police file also, according to which the gold ornaments, which have been given in the list of articles, are the rings etc. given to the relatives of the husband, which prima facie are the marriage gifts and do not fall in the category of dowry articles. Otherwise also, as the petitioners have already joined the investigation, they are not required for custodial interrogation. Further more, they are on interim bail since 2.9.2013 and they have not misused the concession of the anticipatory bail. 6. Keeping in view the facts and circumstances of the present case, I find that no useful purpose will be served by sending the petitioners to custody. Therefore, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the interim order dated 2.9.2013 passed by this Court granting interim bail to the petitioners is made absolute. However, the petitioners shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C. --------------------
