JUDGMENT : This petition filed by the petitioner assails the rejection of candidature for appointment to the post of Aganwadi Worker. 2. The rejection of candidature came to the knowledge of the petitioner vide Annexure P-1 dated 16.9. 2014 passed by the Project Officer Integrated Land Development Project, Kurwai. 3. The dispute regarding the residence of the petitioner was the bone of contention which led to the rejection of candidature, in regard to which certain enquiry was conducted which is evident from the reading of Annexure P-1. 4. Admittedly the dispute involves disputed questions of facts which ought not to be gone into writ jurisdiction under Article 226 especially when the petitioner has failed to avail the remedy of appeal before the Collector and second appeal before the Commissioner as per Clause 6 of the instructions dated 10.7.2014 (vide P/3). 5. This Court thus refrains from going into the merits of the matter relegating the petitioner to file remedy of appeal and second appeal, if necessary, which if filed within a period of 30 working days from today shall be entertained and decided on merits without being dismissed on the question of limitation alone. 6. It is expected of the appellate/2nd appellate authority to decide the dispute expeditiously before creating 3rd party rights on the vacancy in question of Aganwadi Worker. 7. No order as to costs.
