Judgment : P.S. Rana, Judge (Oral) Cr.MP No.________/2014 Be registered. Heard. Application filed for compounding the present case. Court is of the opinion that it is expedient in the ends of justice and to keep cordial relation inter-se the parties to grant permission. Hence permission to compound the case is granted. Cr. Revision No. 279 of 2014 Learned Advocate appearing on behalf of the revisionist submitted that compromise has been executed inter-se the parties and as per compromise revisionist Sh. Pradeep Kumar already paid Rs.1,50,000/- (Rupees one lac fifty thousand) to respondent Sh. Raj Pal Khajuria by way of cash as compensation amount. Sh. Raj Pal Khajuria has admitted that he has received the entire cash amount stated above as compensation amount. Sh. Raj Pal Khajuria further submitted that sentence of imprisonment imposed by the learned trial Court for six months and affirmed by the learned First Appellate Court be set aside and present revision petition be disposed of as per compromise. In view of the above stated facts sentence of imprisonment imposed by the learned trial Court and affirmed by the learned First Appellate Court are set aside and judgment of sentence passed by the learned trial Court is modified to the extent that Pradeep Kumar would pay an amount of compensation of Rs. 1,50,000/- (Rupees one lac fifty thousand) which already stood received by Sh. Raj Pal Khajuria. Statement of learned Advocate appearing on behalf of the revisionist and Sh. Raj Pal Khajuria will form the part and parcel of this order. Certified copy of this order be transmitted to the learned trial Court learned First Appellate Court for information. Certified copy be also sent to the Superintendent of Jail Kanda by way of fax for compliance. Additional Registrar (Judicial) is directed to comply with the order forthwith and issue release warrant forthwith. Revisionist Pradeep Kumar will be released forthwith if not require in any other case.
