JUDGMENT Mr. Ajay Tewari, J. (Oral):- This petition has been filed under Section 438 Cr.P.C. for grant of pre-arrest bail to the petitioner in case FIR No.177 dated 21.07.2014 registered under Sections 306/34 IPC at Police Station Sultanwind, Amritsar City, District Amritsar. 2. The allegations were that the mother of the complainant committed suicide because the petitioner (elder brother of the deceased’s husband) had been troubling her and was not returning her money. 3. Learned counsel for the petitioner has argued that even if these facts are taken to be as gospel truth yet neither in the FIR nor in any subsequent investigation the police has been able to ascertain if the petitioner ever had the intention to drive the mother of the complainant to suicide. As per the learned counsel, without this element of mens rea or even without any proof of the knowledge that their harassment would cause her to commit suicide, Section 306 would not be met out. 4. Learned counsel for the complainant as well as the learned Additional Advocate General have however argued that even in the suicide note the deceased had stated that she committed suicide because of the illtreatment meted out to her by her brothers-in-laws. 5. In these circumstances, without going into the merits of the case, I do not deem it appropriate to deny anticipatory bail to the petitioner. 6. Resultantly, the petition is allowed. In the event of arrest of the petitioner, he shall be released on bail to the satisfaction of the Investigating Officer subject to the conditions envisaged under Section 438(2) Cr.P.C. 7. The petitioner is directed to appear before the investigating officer on 06.10.2014 and on any other date as and when his presence is required. In case the petitioner does not appear before the investigating officer in the aforesaid manner the present petition would be deemed to have been dismissed. 8. Since the main case have been decided, the pending criminal miscellaneous application, if any, also stands disposed of. ------------------
