JUDGMENT Mr. Ajay Tewari, J. (Oral) - This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case F.I.R. No.133 dated 4.8.2013 registered under Sections 22, 61, 85 of the N.D.P.S. Act, Sections 420, 120-B IPC & Sections 18-C/18-A/26-A of the Drugs & Cosmetics Act, 1940 at Police Station Shambhu, District Patiala. 2. The allegations against the petitioner were that he being a wholesaler chemist sent drugs banned under the N.D.P.S. Act to one B.G. Pharma Chemist who has been found to be innocent on the ground that he did not know that the drugs in question has been banned. 3. As per the learned counsel for the petitioner, this lack of knowledge could easily have been attributed to the petitioner also because he sent these drugs under the regular bill. Had the petitioner known that this was banned drug he would have at least not sent it under the regular bills. Further there is no positive material before the police which would show that the petitioner had the knowledge that the drug in question has been banned. He has further argued that the drug in question was banned only in May, 2013 and the whole transaction was the result of lack of knowledge. He has further argued that the petitioner has now been in custody for about one year. 4. Learned Additional Advocate General is not in a position to deny these arguments. 5. Keeping in view the above facts and the period of incarceration already suffered by the petitioner, without going into the merits of the case, I deem it appropriate to release the petitioner on regular bail to the satisfaction of CJM/Duty Magistrate, Patiala. 6. Ordered accordingly. 7. Petition stands disposed of. 8.
