JUDGMENT Hon'ble Arvind Kumar Tripathi (II),J. This criminal revision has been filed challenging the order dated 3.11.2007 by which application for discharge was rejected. Learned counsel for the revisionist informed the Court that revisionist has been acquitted. 2. As proceeding was not stayed and charge was framed, revisional court's power cannot be used for quashing of charge as has been held in the case of State of Maharastra Vs. Salman Salim Khan 2004(48) ACC 606(SC) and Nemichand Jain Vs. Roshan Lal (2004)13 SCC 461 . 3. There is no illegality and perversity in the impugned order. 4. The criminal revision is liable to be dismissed and is hereby dismissed.
