JUDGMENT : When the case was called out in first round, Shri Devendra Sharma, Advocate had appeared on behalf of petitioner and on his request case was put in passover round. In passover round, Shri Sitaram Kushwah, Advocate appeared on behalf of petitioner and prayed for adjourning the case for a week on the strength of his senior Shri Prashant Sharma being out of station. 2. Keeping in view the old pendency of present case, this Court is not inclined to grant any adjournment. I.A.No.11457/2013, an application under Section 5 of Limitation Act for condonation of delay in preferring this petition has been filed. As per the Office note, present petition is barred by 120 days and petitioner has not explained the delay day by day. 3. This revision petition has been preferred by the petitioner calling in question the order dated 08-02-2013 passed by learned Additional Principal Judge, Family Court, Gwalior in MJC No.68/2011 whereby the application filed the respondent seeking interim maintenance was allowed and petitioner was directed to pay Rs.6,000/- in total including the amount to be paid in the case of Restitution of Conjugal Rights, as interim maintenance till final disposal of application moved by the wife under Section 125 of Cr.P.C. 4. In view of the fact that the delay occurred in preferring the present petition before this Court is not explained day by day, therefore, the application for condonation of delay is hereby dismissed. Consequently, the petition is also dismissed.
