JUDGMENT : With the consent of parties, matters are finally heard. 2. At the outset, Shri Prashant Sharma submits that admittedly the charge sheet in the present matters are issued by the Inspector General of Police (I.G.), whereas as per recent DB judgment reported in 2013 (3) MPLJ. 508 (Arun Prakash Yadav Vs. State of M.P. and others), it is made clear that Police Regulations would be applicable to the exclusion of M.P.Civil Services (Classification, Control & Appeal), Rules, 1966. In para 36(3), it is made clear that as per Regulation 228 of Police Regulations, the Superintendent of Police alone is competent authority to initiate disciplinary proceedings/issue charge sheet for major penalties against an Inspector of Police. 3. Learned counsel for the parties fairly submit that aforesaid point is covered by the DB judgment in Arun Prakash Yadav (supra). Considering the aforesaid, the charge sheet, subsequent proceedings and orders are set aside. Liberty is reserved to the respondents to proceed against the petitioner in accordance with law. With the aforesaid, petition stands disposed of.
