JUDGMENT: Perused the records. I.A.No.14575/2014 an application for condonation of delay in filing the MCC is considered and allowed. The delay in filing the MCC is condoned. This M.C.C. is filed for restoration of R.P. No.483/2013, which was automatically dismissed due to the common conditional order passed by this Court on 10.1.2014. It is contended by learned counsel for the applicant that the Review Petition was dismissed for non-compliance of the order. This MCC is preferred on the ground that for the mistake of the counsel, the applicant should not be penalized. If the Review Petition is not restored, the applicant would suffer irreparable loss. The applicant is very much interested in prosecuting the Review Petition. Such contentions are supported by the affidavit of counsel for the applicant. Considering the aforesaid, this M.C.C. is allowed. Let Review Petition No.483/2013 be restored on its original number on removal of default pointed in the Review Petition within a period of three days from today, failing which the order of dismissal of Review Petition would remain operative. In case of restoration, Review Petition be listed before the Appropriate Bench for hearing. The M.C.C. stands allowed and disposed of.
