JUDGMENT: Perused the records. I.A.No.13984/2014 an application for condonation of delay in filing the MCC is considered and allowed. The delay in filing the MCC is condoned. This M.C.C. is filed for restoration of CON.C. No.977/2014, which was dismissed for want of prosecution by this Court on 31.7.2014. It is contended by learned counsel for the applicant that when the case came up for hearing on 31.7.2014, the mother of the counsel for the applicant suddenly fell sick and he had taken his mother to the hospital. Consequently, the Contempt Case was dismissed for want of prosecution. This MCC is preferred on the ground that for the mistake of the counsel, the applicant should not be penalized. If the Contempt Case is not restored, the applicant would suffer irreparable loss. The applicant is very much interested in prosecuting the Contempt Case. Such contentions are supported by the affidavit of counsel for the applicant. Considering the aforesaid, this M.C.C. is allowed. Let CON.C. No.977/2014 be restored on its original number and be listed before the Appropriate Bench for hearing. The M.C.C. stands allowed and disposed of.
