JUDGMENT: Heard on admission. This writ petition under Article 227 of the Constitution of India is filed seeking a direction against the Executing Court to execute the decree/award granted in favour of the petitioners, which application was filed in the year 2012. From the order-sheet placed on record, it is clear that the warrant of attachment of the tractor and property was issued by the Executing Court and the dates were fixed, but on every such occasion the date was just short of sufficient time and therefore, the warrant of attachment could not be served on the respondents-judgment debtors and returned by the serving authority with an endorsement that the attachment warrant is returned back unserved. Keeping in view the aforesaid, it is directed that the Executing Court will see that the sufficient time is allowed for service of the warrant of attachment to be issued on the next date and will fix the hearing of the case accordingly. The Executing Court will also ensure service of the warrant of attachment by special process server, if required and to conclude the proceedings of the Execution Case within a period of six months from the date of receipt of certified copy of the order passed today. The writ petition stands disposed of. C.C. as per rules.
