JUDGMENT Hon'ble Dilip Gupta,J. According to the petitioner, who claims to be the holder of land bearing Plot No.148 situated in Village-Karaundi Kalan, Pargana Barsathi, Tehsil Madhiyahun, District Jaunpur, there is a chakroad on the northern boundary of the plot. However, it is being alleged that this chakroad is being widened and metalled so as to cause encroachment on the land of the petitioner. In our view, the remedy for the petitioner is to take recourse to the provisions of Section 41 of the U.P. Land Revenue Act, 1901 for demarcation of the land. If the petitioner makes an application, we direct that necessary steps should be taken for carrying out the demarcation expeditiously so as to enable the petitioner to seek recourse to his remedy in the event, it is found that in the course of widening the chakroad, any part of the land belonging to the petitioner has been encroached. The writ petition is, accordingly, disposed of.
