JUDGMENT Mr. Inderjit Singh, J.: - The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.410 dated 15.12.2013 registered for the offences under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 25 of the Arms Act at Police Station Civil Lines Amritsar, District Amritsar. 2. Notice of motion was issued in this case. 3. Mr. S.S. Chandumajra, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition. 4. I have heard learned counsel for the parties and have gone through the record. 5. As per the prosecution version, the FIR has been registered on the basis of secret information against Mangal Singh and Saurav Partap. The raid was conducted. Saurav Partap was apprehended on the spot with 250 Grams intoxicant powder. The petitioner is stated to have run away from the spot. Nothing has been stated to be recovered from the present petitioner as he ran away from the spot. The petitioner has joined the investigation. He is not required for custodial interrogation. No useful purpose will be served by sending him to custody. 6. Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the interim order dated 20.5.2014 passed by this Court granting interim bail to the petitioner is made absolute. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C. ---------0.B.S.0------------ —————————
