JUDGMENT Hon'ble Devendra Kumar Upadhyaya, J. The petition which has been filed in the public interest highlights the poor and unsafe condition of a road which connects Lucknow-Hardoi State Highway from Nanak Ganj to Railway Godown over a stretch of 3.765 kms. The road was constructed in 2008-09 by the Public Works Department. The petitioner has stated that as a result of the poor condition of the road, the payment due to the construction contractor has been stopped. The petitioner has submitted several representations which are annexed to the petition. We are satisfied that in the interest of the public and to ensure safety and convenience, it is necessary for the Public Works Department to take remedial measures for the restoration of the road. The photographs which are annexed as Annexure-2 to the petition show that the condition of the road is very pathetic and unsafe. 2. In the circumstances, we direct the second and third respondents to take appropriate steps for the restoration of the road. We clarify that this order shall not affect any steps which the respondents are required to take to ensure compliance with the contractual obligation by the concerned contractor and for holding the supervisory and other staff responsible for the lapses that have occurred. 3. The petition is, accordingly, disposed of. There shall be no order as to costs.
