Judgment Dharam Chand Chaudhary, J. 1. Learned Additional Advocate General has placed on record the status report and Investigating Officer, ASI Man Singh of Police Station, Kullu (SIU Branch), has produced the record. 2. The allegations against the accused-petitioner, in a nutshell, are that he agreed to receive a child abducted and brought to Kullu by his co-accused Surender Mandal and Parmod Kumar Yadav from Bihar on payment of consideration. The vehicle in which three children were being brought to Kullu area by the co-accused of the accused-petitioner for being exploited, however, was intercepted by Kullu police at Dhalpur Chowk consequent upon a secret information received in this behalf. The accused-petitioner was also nabbed at that place and when interrogated by the police, disclosed that he has negotiated the matter to receive one of the child over telephone with his co-accused on payment of consideration and he had come there for the purpose. He was also found to have his pass book with him against which he had to get the money withdrawn from his bank account for payment to aforesaid Surender Mandal and Parmod Kumar Yadav. The alleged deal, however, could not be finalized as the accused-petitioner neither could receive the child nor make the payment to his co-accused being nabbed well before doing so by the police. He is a local resident of District Kullu. Now nothing is to be recovered from him. He has been arrested in this case on 13.2.2014 and is in judicial custody. 3. In the given facts and circumstances and also that the accused-petitioner is no more required for further interrogation, this application is allowed.

Consequently, it is ordered that the accused-petitioner, who has been arrested in connection with the case registered against him under Sections 363, 365, 367, 370 and 120B of Indian Penal Code and Section 26 of J.J. Act of 2000 vide FIR No.51 of 2014 in Police Station, Kullu (SIU Branch), District Kullu, if not required in any other case, be released on bail subject to his furnishing personal bond in the sum of Rs.50,000/- with one surety in the like amount to the satisfaction of learned Chief Judicial Magistrate, Kullu and shall abide by further conditions that: He shall:- (a) Regularly attend the trial Court on each and every date of hearing and if prevented by any reason to do so, seek exemption from appearance by filing appropriate application. (b) Not tamper with the prosecution evidence nor make any inducement, threat or promises to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court. (c) Not leave the territory of India without the prior permission of the Court. 4. It is clarified that if the petitioner misuses the liberty or violates any of the conditions imposed upon him, the investigating agency shall be free to move this Court for cancellation of the bail. 5. The observations made hereinabove shall not be construed to be a reflection on the merits of the case and shall remain confined to the disposal of these petitions alone.
