JUDGMENT Mr. M. Jeyapaul, J.: - Reply filed is taken on record. 2. The petitioner Surender Kaur who was granted four weeks parole right from 17.10.2014 to 15.11.2014 has sought for extension of parole for another one month on the ground that she has to spend time with her only child and she also has to receive medical treatment for AIDS. 3. The learned counsel appearing for the Writ Petitioner would submit that the petitioner is HIV positive and she has to undergo medical treatment. Further, the only child will have to be taken care of by the applicant, as the husband of the Writ Petitioner having availed parole has already surrendered as per the terms of parole granted to him. It is also brought to our notice by the learned counsel appearing for the Writ Petitioner that the application dated 29.10.2014 seeking extension of parole was submitted to the Inspector General of Police, Punjab but the same was not disposed of so far. 4. The learned State counsel appearing for the State of Punjab would submit that the prayer for parole will have to be determined only by the Executive Authority. It is his further submission that the application submitted by the applicant is pending disposal before the Inspector General (Prisons), Punjab. 5. It is not as if the Writ Petitioner is the only convict who has been afflicted with HIV positive. There are number of prisoners in jails all over the country who have been afflicted with HIV positive. Proper treatment is being given to such prisoners by the jail authorities concerned. Further, in our view, the Writ Petitioner who has gone on parole on certain terms and conditions imposed by the jail authorities cannot come to this Court seeking extension of parole. In a case where this Court sets aside the order passed by the jail authorities, exercising its revisional jurisdiction, it may of course consider extension of parole granted. 6. In view of the above, directing the Inspector General (Prisons), Punjab to dispose of the application dated 29.10.2014 submitted by the Writ Petitioner within one week from the date of this order, the Writ Petition stands disposed of. ---------0.B.S.0------------ —————————
