JUDGMENT Mr. Inderjit Singh, J.: - The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.221 dated 20.9.2014 registered for the offence under Section 498-A IPC at Police Station Sadar Amritsar, District Amritsar. 2. Notice of motion was issued in this case. 3. Mr. S.S. Chandumajra, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and Mr. Ranjit Sharma, Advocate has appeared on behalf of the complainant and contested this petition. 4. Learned counsel for the complainant stated that there are allegations regarding beating by the present petitioner to the complainant and also that he has contracted second marriage, which fact has been denied by the petitioner. 5. Learned counsel for the petitioner has stated that these false allegations are levelled against the petitioner. Learned counsel for the petitioner also contended that the petitioner is ready for compromise on whatever term the complainant agrees. 6. On the other hand, learned counsel for the complainant requested that the case may be sent for mediation as both the parties state that there is possibility of compromise also. 7. I have heard learned counsel for the parties and have gone through the record. 8. From the record, I find that the present FIR is for the offence under Section 498-A IPC only regarding harassment and cruelty etc. for demand of dowry etc. The petitioner has already joined the investigation and he is not required for custodial interrogation. Otherwise also, as the FIR is only for the offence under Section 498-A IPC, therefore, nothing is to be recovered from him. No useful purpose will be served by sending the petitioner to custody. 9. Keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the interim order dated 17.10.2014 passed by this Court granting interim bail to the petitioner is made absolute. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C. 10. As the parties state that there is possibility for compromise, therefore, they are directed to approach the learned Sessions Judge, Ludhiana for sending their case of the Mediation and Conciliation Centre for mediation. ---------0.B.S.0------------ —————————
